Step 1: Sponsorship Stage


Before an employer can sponsor an overseas worker, they must first become an approved business sponsor. To qualify, the employer must provide evidence that they:

  • Are a legally established and currently operating business in Australia.

  • Have no adverse information recorded against them.

  • Have a strong record or commitment to employing local labour.

Once approved, sponsorships remain valid for five years, allowing the business to nominate multiple skilled workers during that period.

Step 2: Nomination Stage


Once sponsorship approval is granted, the employer can proceed to nominate an overseas worker for a specific position.

At this stage, the employer must demonstrate that genuine efforts have been made to hire locally, including:

  • Conducting labour market testing and recruitment activities within the past four months.

  • Publishing at least two advertisements in credible, national platforms such as:

    • Seek, Indeed, or Jora

    • National newspapers or radio

    • The business website (for accredited sponsors)

  • Keeping advertisements open for a minimum of four weeks, accepting applications throughout that period.

Additionally, sponsors must comply with salary and employment condition requirements to ensure that overseas employees receive pay and benefits equal to or better than local Australian workers doing the same job in the same location. This standard is known as the Annual Market Salary Rate (AMSR). Employers must also provide a valid employment contract that meets Australian Employment Standards.


Step 3: Visa Application Stage


After the nomination is approved, the overseas worker can apply for the Subclass 482 Visa. Applicants must provide:

  • Proof of identity

  • Skills assessment (or evidence that one has been arranged). Even if not mandatory, applicants must still demonstrate relevant skills, qualifications, and experience.

  • English proficiency – minimum IELTS overall 5.0, with at least 5.0 in each band, or equivalent test scores.

  • Adequate health insurance for themselves and any secondary applicants.

  • Overseas police certificates from every country lived in for 12 months or more in the last 10 years (since turning 16).

  • Military service records or discharge papers (if applicable).

  • Documents for dependents or partners, including proof of relationship and character documents.


Pathways to Permanent Residency


Holders of the Subclass 482 Visa across all streams may become eligible to apply for permanent residency through the Employer Nomination Scheme (Subclass 186 Visa) after two years of full-time employment in their nominated occupation.

Key PR requirements include:

  • Being under 45 years of age at the time of application.

  • Achieving an IELTS score of at least 6.0 in each band, or an equivalent English test score.

  • Meeting character, health, and employment requirements.
