Business Visa

Business visa offers two predominant pathways for successful business talents to invest in, develop and manage their business in Australia while attainting permanent residency. This visa requires nomination by the state/territory government or Australian government following a successful EOI.

132 Business Talent visa

 

The Business Talent visa (subclass 132) is a permanent residence visa for business people who are nominated by an Australian state or territory government agency. State and territory authorities have their own criteria for deciding who to nominate. The authority might contact you before you are nominated to discuss business possibilities. This may be to make a designated investment of at least AUD1.5million into setting up and maintaining business activity in an Australian state or territory for at least 2 years. As this visa does not require applicant to have an English language assessment and residency restriction, this visa is suitable for business people are unable to remain in Australia on a long-term basis.

 

There are two streams:

  • Significant Business History stream is for high-calibre business owners or part-owners who want to do business in Australia. You have a total net asset of at least AUD400,000 as the ownership interest in one or more qualifying businesses for least two of the four fiscal years in one or more of your qualified businesses. You have a net business and personal asset of at least AUD1.5 million and an annual business turnover of at least AUD3 million.

 

  • Venture Capital Entrepreneur stream is for people who have sourced venture capital funding, at least AUD1 million, from a member of the Australian Venture Capital Association Limited (AVCAL).The funding must be for the start-up, product commercialisation or business development of a promising high-value business idea.

 

Application Requirement

Significant Business History stream

  • have net business and personal assets of at least AUD1.5 million and an annual business turnover of at least AUD3 million

 

Venture Capital Entrepreneur stream

  • Have obtained at least AUD1 million in venture capital funding to start the commercialisation and development of a high-value business idea in Australia.

188 Business Innovation and Investment (Provisional) Visa

 

The Business Innovation and Investment (Provisional) visa (subclass 188) is part of the Business Innovation and Investment Programme. A nomination by the state/territory government or Australian government will follow upon a successful EOI. This visa requires a score of at least 65 in the points test and has an age restriction, limited to people under 55 years old.

 

The visa includes four streams:

  • Business Innovation stream: for people with business skills who want to establish, develop and manage a new or existing business in Australia. Applicants must be nominated by a state or territory government.

 

  • Investor stream: for people who want to make a designated investment of at least AUD1.5million in an Australian state or territory and maintain business and investment activity in Australia. Applicants must be nominated by a state or territory government.

 

  • Significant Investor stream: for people who are willing to invest at least AUD5million into complying significant investments in Australia and want to maintain business and investment activity in Australia. Applicants can be nominated by a state or territory government or Austrade on behalf of the Australian government.

 

  • Premium Investor stream: for people who are willing to invest at least AUD15million into complying premium investments in Australia and want to maintain business and investment activity in Australia. Applicants must be nominated by Austrade on behalf of the Australian government.

892 State/Territory Sponsored Business Owner Visa

 

The State/Territory Sponsored Business Owner visa (subclass 892) is for people who own a new or existing business and are sponsored by a state or territory authority. Before you apply you must get sponsorship from the regional authority in the state or territory in which you intend to continue your main business. You must be involved in an active business and has lodged tax with the ATO for the business for the last 2 years and demonstrating an annual turnover of at least AUD200,000 in the last 12 months.

 

Application Requirement

  • Hold one of the following provisional visas granted on the basis that you or your current or former spouse or de facto partner satisfied the primary criteria:

    • Business Owner (Provisional) visa (subclass 160)

    • Senior Executive (Provisional) visa (subclass 161)

    • Investor (Provisional) visa (subclass 162)

    • State/Territory Sponsored Business Owner (Provisional) visa (subclass 163)

    • State/Territory Sponsored Senior Executive (Provisional) visa (subclass 164)

    • State/Territory Sponsored Investor (provisional) visa (subclass 165)

  • Meet all the conditions of your provisional visa.

  • Sponsored by a state or territory authority.

  • Lived in Australia on one of these visas for at least 12 months in the past two years.

  • Have a genuine commitment to continue to maintain business or investment activities in Australia.

  • Neither the applicant nor their partner has ever been involved in unacceptable business activities.

  • Meet health and character requirements.
